Summary of Shari Jurisdiction assignments in Palestine

By uniting the administrative and judicial sides of Shari Jurisdiction in Palestine, Shari Jurisdiction has witnessed a development - in all levels -which improves the work of Sharia Courts and offers services for people smoothly. Shari Jurisdiction has an important position and a distinguished role on the external and internal levels, it has the following bodies:
1- The Highest Council of Shari Jurisdiction:
The presidential decree of forming the Highest Council of Shari Jurisdiction was issued in Palestine in 19-9-2003 and it has the following authorities:
1- Appointing Shari judges, their transference and promotions.
2- Changing the work location of judges.
3- Accepting the resignation of judges.
4- Referring judges to retirement.
5 Prosecuting judges.
6- Isolating judges or considering them incompetent.
7- Delegating judges if the delegation period exceeds three months.
8- Supporting the affairs and causes of Moslems in the world.
2-Sharia Supreme Court :
Sharia Supreme Court has been established on the basis of the resolution of Palestine president Yasir Arafat ;the presidential decree was issued in 19-9 -2003 coincident with his resolution of establishing the Highest Council of Shari Jurisdiction .
By establishing the Sharia Supreme Court, the prosecution ranks in Palestinian Sharia Court become three; instance, appeal and supreme courts.
The Supreme Court is a law court like the court of cassation; it has united the judicial jurisprudence in Palestine so it is considered as the top of the Shari jurisdiction pyramid.
3- Courts of Appeal:
They are the second class in prosecution in Sharia courts in Palestine. His Eminence the supreme judge reformed appeal courts in Jerusalem making them with two bodies.
The center of session -for the first one- is in Jerusalem. The center of session -for the second one- is in Nablus . The nature of the work of appeal court is showed in the Shari Procedural Law.
4-Courts of the First Instance:
1- They are the first class in prosecution.
2 -They have an important role.
3 -They take care of the individual before birth by medical checkup before marriage and in all the stages of his life and take care of him after death by distributing his heritage between his heirs.
